Henry was convicted at Berrima on 9 Sept 1844 of murder John Daly on 16 January 1844 and sentenced to death.

Henry arrived Sydney aged 21 aboard Captain Cook on 13 November 1836 with Indent showing alias "Atkins" and trade soldier and farm servant.

Henry was born about 1815 Fifeshire Scotland and convicted Wexford Ireland in 1836 of "receive stolen goods" and sentenced to 7 years transportation.
