Joseph was convicted at Warwick Assizes about 1830 and sentenced to life transportation, he arrived Sydney aboard Lord Melville on 21 October 1830

Joseph was convicted on 18 Mar 1844 Maitland with Mary Baker (Surrey) of poisoning murder John Thornton (Mary's husband) on 16 Jan 1844 at Mulberry Creek near Newcastle and both sentenced to death.
