Mary was convicted at Central Criminal Court on 3 February 1840 of robbery and sentenced to 10 years transportation, she arrived Sydney aboard Surrey on 13 July 1840 .

Mary was convicted on 18 March 1844 Maitland with John Vale (Lord Melville) of poisoning murder of her husband John Thornton (Mary Ann) on 16 Jan 1844 at Mulberry Creek and both sentenced to death
