Biographies
Herbert together with Joseph Burridge (General Hewitt 1814) and John Pearce (Indian 1810) and Edward Scare (Admiral Gambier 181) committed piracy on 7 April 1814 by taking control of the schooner "Speedwell" at Newcastle and escaping the Colony. they have not been seen subsequently.

Herbert was convicted at Calcutta of piracy on 4 December 1809 and sentenced to life transportation, he arrived Sydney aboard Eagle on 17 February 1811.

Herbert was transferred to Newcastle aboard "Estramina " on 23 April 1813 and is later noted as escaping on 7 May 1814,with three other convicts.
