Benjamin was born about 1806 Staffordshire and was convicted at Dublin Court Martial in 1833 of insubordination and sentenced to life transportation

Benjamin arrived Sydney aged 28 aboard James Laing on 29 June 1834 with his Indent showing trade "soldier".

Benjamin was convicted on 19 September 1843 at Maitland of the shooting murder of Constable Rutledge on 6 May 1843 near Merton NSW and sentencd to death.
