John was one of eleven men tried for the part he played in one of Australia's greatest atrocities the Liverpool Plains Massacre (Myall Creek Massacre) of 1838.
It was alleged that he and ten others wilfully massacred up to 30 aboriginal people on 10 June 1838 and subsequently desecrate and burn their bodies.
At a first trial on 15 November 1838 at Supreme Court Sydney all eleven were acquitted but remanded, however with new evidence;
Seven of the men were retried on 27 November 1838 at Supreme Court Sydney with all seven being found guilty and sentenced to death. William Hawkins, John Russell, John Johnson, Charles Kilminster, Edward "Ned"Foley, James Oates & James Parry.
All seven were hanged in Sydney on the morning of 18 December 1838.
