Biographies

Henry John Warland was my 3rd Great Uncle, he was convicted for life but this was commuted to 7 years. Initially he served his sentence on Norfolk Island but was then transferred to Van Diemans Land where he completed his sentence. By 1867 he was back in England as he married his second wife Elizabeth Thomasin Adams after the death of his first wife due to miscarriage. His daughter to his first wife died in 1852 and is buried in the Community Cemetery at Canford Magna in Dorset. He then had four further children to his second wife. He eventually died in Middlesex at the age of 61 years in 1883. Henry John was tried and convicted at Dorchester Assizes for the rape of his 16 year old servant girl. His trial was 16 July 1845 and he was aged 23. He was transported to Norfolk Island aboard the "China" for life leaving from Woolwich between Jan 4-6 1846 and arriving at Norfolk Island 16 May 1846.. His sentence was commuted to 7 years. But in 1849 he was transferred to Van Diemans land (Tasmania) per the Lady Franklin arriving the 1 Mar 1849 where he remained until he was issued with a Ticket of Leave with a pardon. A conditional pardon was recommended 11 Feb 1850 and was approved 1 Apr 1851 He was given his freedom the day before 30 March 1851 The condition of his pardon was upon condition that they shall not return to or be found within the countries in which they were severally convicted, or the United Kingdom of Great Britain and Ireland, during the remaining term of their sentence of transportation. Assuming he complied with this condition, he would have been free to travel back to England in 1853 as that would be the 7 years sentence completed It is a fact that on his daughters death certificate it says she was the daughter of Henry Warland, a Plumber From the Founders and Survivors Database UTASJuly 19 1847 it says he received 7 days hard labour in chains for trying to sneak a letter via a soldier while on Norfolk Island.Also whilst at Norfolk Island he received punishment as follows:- 10 July 1848 Neglect of Duty 14 Days solitary confinement. 12 Sept 1848 Neglect of Duty. Admonished but for record posted after man to Van Diemans Land.. Once at VDL on the 15th June 1850 he was accused of uttering a forged order for the payment of40 pounds. Discharged 6 Nov 1849 issued Ticket of Leave.
