On the 24th of July 1845, Cuthbert was convicted in County Durham of the crime of Robbery with Violence. This was his first conviction. Cuthbert was sentenced to Transportation to Australia for 15 years.
Cuthbert departed England on the 3rd of January 1845 on the Convict Transport ship ‘China’. He arrived at the Norfolk Island penal Settlement, Australia on the 16th of May 1845. He was aged 22.
Cuthbert died on Norfolk Island on the 31st of October 1846, five and a half months after arriving.
It is quite possible that Cuthbert was a witness and possibly involved in the Cooking Pot Riot, which took place at Kingston, Norfolk Island on the 1st of July 1846. Twelve convicts (the ringleaders) were subsequently hanged and buried in unhallowed ground on Norfolk Island.
